The terms used below have the following meaning in these Terms and Conditions of Sale:

      • “Customer”: means the Seller’s co-contracting party, who warrants that they qualify as a consumer as defined by French law and case law. As such, it is expressly agreed that the Customer is acting outside any habitual or commercial activity.

      • “Territory”: means all the delivery countries offered on the Website when placing an order.

    ARTICLE 4 – SCOPE

These Terms and Conditions of Sale are reserved exclusively for consumers, as defined by law and case law, acting solely on their own behalf and residing in one of the delivery countries offered on the Website.

ARTICLE 5 – ENTRY INTO FORCE AND DURATION

These Terms and Conditions of Sale enter into force on the date the order is confirmed.

    ARTICLE 6 – ACCEPTANCE

This step amounts to acknowledging that they have read and fully understood, and accept, these Terms and Conditions of Sale.

    ARTICLE 7 – PRODUCTS

The products offered for sale are those shown on the Website on the day the Customer consults the Website.

They are offered for sale while stocks last.

    ARTICLE 8 – PRICES

Prices are shown on the Website in pounds sterling, inclusive of all taxes. Any delivery charges are indicated before the order is confirmed.

    ARTICLE 9 – ORDERS

Placing an order on the Website is subject to compliance with the procedure put in place by the Seller.

    ARTICLE 10 – PAYMENT

Purchases are paid for by bank card. To make a payment, you must be at least 18 years old and hold a bank card (credit or debit) that you are entitled to use.

    ARTICLE 11 – DELIVERY

Delivery is made by Royal Mail or another tracked carrier, to the address given by the Customer when placing the order.

The Seller undertakes to deliver the products ordered by the Customer within the specified timeframes, except in cases of force majeure or where the Customer is at fault.

ARTICLE 12 – RIGHT OF WITHDRAWAL

The Customer has a withdrawal period of 30 days from receipt of the products in which to exercise their right of withdrawal, without having to give any reason or pay any penalty.

Returns are free: return costs are borne by us.

    Here is the returns procedure:

Exchanges and returns can be made within 30 days of receiving your order.

If you wish to exercise this right, please contact us, explaining the situation and what you would like as precisely as possible.

Here is how the process works:

    A. You wish to return or exchange an item that is not right for you.

        • Check that you are still within the 30-day period.

        • Preferably keep the labels attached: an item whose labels have been removed can no longer be resold as new, and its loss of value may be deducted from the refund.

        • Preferably return the item in its original packaging: missing or damaged packaging may be counted towards the loss of value deducted from the refund.

        • You may try the item on just as you would in a shop; if it has been worn beyond simply trying it on, or washed, its loss of value will be deducted from the refund, up to its full price.

Then contact us (photos of the product optional, to speed up processing) via the contact form.

You will receive a returns form, which you will need to complete and place in your parcel.

That said, this form can also be downloaded from your customer account.

If you don’t have a printer, don’t panic: copy out everything on the returns form and put the sheet of paper in your parcel.

That said, do check that you haven’t forgotten anything, namely:

          • The order number.

          • The names of the items being returned.

          • What you would like (refund, store credit, exchange).

Then send the product back to the address shown on the returns form, no later than thirty days after informing us of your decision; this return is free of charge for you.

Finally, as soon as the item is received, it will be examined and, depending on your request, exchanged or refunded.

Please note that we reserve the right to refuse returns that were not notified to us within the withdrawal period. If a product has been handled beyond what is necessary to establish its nature, characteristics and proper functioning (used, worn beyond simply trying it on, washed, damaged or incomplete), we will deduct the amount of its loss of value from the refund, which may be up to its full price.

Once the return has been received and examined, you will receive a confirmation email stating the amount refunded.

The refund is made no later than fourteen days after you have informed us of your withdrawal, using the payment method used for the order. We may, however, defer it until we have received the goods or until you have provided proof of having sent them, whichever comes first: until we have one or the other, no refund is due, even if those fourteen days have passed.

        Withdrawal form

(Please complete and return this form only if you wish to withdraw from the contract.)

For the attention of Damien Riou EI, 15 rue des Halles, 75001 Paris, France, contact@tenue-traditionnelle.fr:

I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods (*)/for the provision of the following service (*):

        Ordered on (*)/received on (*):

        Name of consumer(s):

Signature of consumer(s) (only if this form is notified on paper):

If you requested an exchange, you will also receive a confirmation email and a new tracking number.

        B. You wish to return an item that has a defect.

We do everything we can to ensure that every item is of the highest possible quality and arrives in excellent condition.

Nevertheless, should there be any problem at all, we apologise in advance.

In that case, here is the procedure:

            • Fill in the contact form, attaching photos of the product. These must show the product in full, and then its defects.

            • Never clean or wash an item, even if it has a stain, whatever its defect; please let us know before doing anything of the sort, so that we can examine it as is. The return costs for a defective item, or one that does not match your order, are borne by us.

            • Your request will be processed within 48 hours.

            • You will have the choice between a refund, store credit or an exchange.

Your satisfaction is our greatest goal.

          C. Products that cannot be returned

Some products, by their nature, cannot legally be returned.

This includes products unsealed after delivery that cannot be returned for reasons of hygiene or health protection.

ARTICLE 12 Bis – DELIVERY TIMES

          Here are the delivery times:

          A) For the UK and Western Europe

To process your request, prepare your order and finally dispatch it, here are our timeframes: we need around 24 to 48 hours to dispatch it (Monday to Friday) and 1 to 2 days for transit (Monday to Friday).

Please be assured that we do everything we can to fulfil orders as quickly as possible.

These timeframes do not, however, apply in cases of force majeure.

          ARTICLE 13 – WARRANTIES

The Seller is bound by the legal warranty of conformity (Articles L. 217-1 to L. 217-32 of the French Consumer Code) and the legal warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code), set out in the box below in accordance with Article D. 211-2 of the French Consumer Code.

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity, and not the date on which it appeared.

Where the contract of sale for the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal warranty applies to that digital content or digital service throughout the intended supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared.

The legal warranty of conformity obliges the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal warranty of conformity entitles the consumer to the repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer asks for the goods to be repaired but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for returning the goods, if:

          1° The trader refuses to repair or replace the goods;

          2° The repair or replacement of the goods takes place after a period of thirty days;

          3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer ultimately bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;

4° The non-conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining warranty period until the repaired goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs the implementation of the legal warranty of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for returning the goods.

After-sales service can be reached by email at contact@tenue-traditionnelle.fr.

Sending an email is free of charge

          ARTICLE 14 – LIABILITY

The Seller accepts no liability for damage resulting from misuse of the product purchased or for damage caused by use that does not comply with safety standards.

          ARTICLE 15 – PERSONAL DATA

The Seller retains the personal data provided by the Customer in accordance with its legal obligations (accounting, invoicing, etc.).

The Customer has the right to access, rectify and delete the data concerning them.

          ARTICLE 16 – DISPUTES

Any dispute relating to the existence, interpretation, performance or termination of the contract concluded between the Seller and the Customer, even where there are several defendants, shall, failing an amicable settlement, fall within the exclusive jurisdiction of the French courts.

Nevertheless, it is also possible to refer the matter to a mediator.

Here are the mediator’s contact details:

          Website: https://www.mediateurfevad.fr/

Postal address: Médiateur de la consommation FEVAD – BP 20015 – 75362 PARIS CEDEX 8

ARTICLE 17 – LANGUAGE OF THE CONTRACT

These Terms and Conditions of Sale are drafted in French.

Should they be translated into one or more foreign languages, only the French text shall be authoritative in the event of a dispute.

          Article 18 – Fraud

In the event of attempted fraud, unauthorised payment or any other unlawful act, your information will be passed on to the relevant authorities.

          Article 19 – Promo codes

The current promo code, displayed on product pages along with its end date, entitles you to a 5% discount on the entire contents of your basket. Each code is valid until 11:59pm on the Sunday of the current week, after which it expires.

You can add this promo code on the basket page or when placing your order.

Article 20 – Data protection commitment

We are committed to protecting your data as well as we possibly can.

That is why our site is encrypted over HTTPS with an SSL certificate, why our database and all the information it contains are encrypted too, and why all the software that keeps the site up and running is kept up to date.

We also take great care in selecting the platforms we use, in order to avoid this type of situation.
